Montenegrin Supreme Court suspends Do Kwon’s extradition to South Korea: report

The Supreme Court of the southeastern European nation of Montenegro has again postponed the extradition of Terra (LUNA) co-founder Do Kwon to South Korea.

According to a report by Montenegrin news channel Vijesti, the Supreme Court of Montenegro halted the extradition due to a request for “protection of legality” of Kwon’s camp.

According to a statement from Montenegro’s Supreme Court:

“At today’s session of the council, a decision was adopted that determines the postponement of the implementation of the decision of the Supreme Court in Podgorica and the Court of Appeal of Montenegro, until the decision of the Supreme Court on the request for the protection of legality , which will take place within the statutory period.”

This is the second time this year that the Southeast European Supreme Court has postponed Kwon’s extradition to South Korea.

In March, they pumped the brakes on extradition for the first time, claiming lower courts did not follow the law when they initially approved Kwon’s extradition.

Earlier that same month, Kwon’s extradition to the United States was also revoked due to procedural violations.

Then, in June, the Podgorica High Court ruled that Kwon should be handed over to South Korea and not to the US, because the extradition request from Kwon’s home country arrived before that of the US.

The Court of Appeal at the time expressed support for the Supreme Court’s ruling and also noted that there was no appeal against its decision.

However, last week an appeals court in Montenegro upheld the lower courts’ original decision on Kwon’s extradition.

Kwon was arrested in Montenegro in March 2023 after trying to board a flight to the United Arab Emirates (UAE) using a forged Costa Rican passport. He is facing criminal charges in the United States and South Korea in connection with the multibillion-dollar collapse of Terra and its stablecoin.
