Montenegro’s Supreme Court has postponed the extradition of disgraced Terra (LUNA) founder Do Kwon to South Korea.
According to a new memo, Montenegro’s Supreme Court is overturning an earlier ruling that greenlighted the extradition process to return Kwon to his home country of South Korea, where he is wanted for alleged crimes related to the demise of the Terra ecosystem in 2022 .
The Supreme Court said the lower courts did not follow the law when they initially approved Kwon’s extradition.
“In the specific case, the court, contrary to the law, conducted an abbreviated procedure instead of a regular procedure and, by exceeding the limits of its powers, decided on the extradition permit, which is the exclusive competence of the Minister of Justice.”
Moreover, the Supreme Court says that the procedure was violated because the Court of Appeal, contrary to the law, did not hear the public prosecutor.
“The request for protection of legality was also raised because the Court of Appeal had not heard the prosecutor of the Supreme Court of Public Prosecution in the appeal proceedings, contrary to the provisions of the [law]providing that only the Supreme Court of the State shall act before the Court of Appeals.”
Kwon was initially arrested in Montenegro in March 2023 after attempting to board a flight to the United Arab Emirates (UAE) using a forged Costa Rican passport. He is facing criminal charges in the United States and South Korea in connection with the multibillion-dollar collapse of Terra and its stablecoin.
Earlier this month, Kwon’s extradition to the United States was also revoked due to procedural violations.
