Tornado Cash founder Roman Storm’s Legal Team accuses the government of withholding information from the court.
Storm was arrested in 2023 and beaten with charges with regard to alleged money laundering of $ 1 billion in criminal revenues, including hundreds of millions of dollars for the Lazarus group, the sanctioned North Korean cyber criminal outfit.
The founder of the Tornado Cash was also responsible for operating a non-registered money-overspring, although that part of the indictment was dropped earlier this month in accordance with a memo of April Ministry of Justice (DOJ) that encouraged digital assets “Regulation by prosecution”. The prosecutors still pursue the other charges.
Now the Storm lawyers claim that prosecutors have been holding on to relief material since 2023 about their claims that not -care crypto -mixers can act as money channels.

During that call, Fincen officials stated that because Samourai ‘the custody’ of the Cryptocurrency ‘did not take by possessing the private keys into addresses where the cryptocurrency is stored, which would strongly suggest that Samourai is not (the emphasis in original) that works an MSB [money services business/money transmitting business]. ” ‘
Although the government has dropped the non-registered money-transmitter section of the indictment, Storm’s lawyers still claim that it is a failure to make those documents a “Brady violation” and the defense of the Tornado founder of the Tornado-Cash has “materially defined”.
Brady violations involve officers of justice who do not announce relevant evidence that would help the case of a suspect. They can lead to beliefs, mistrials, dismissal and/or prosecution of misconduct.
The storm process is planned for July 14.
